
Hoffmans wins $65,000 verdict against Surgeon
17th December 2003 - Perth Law Firm Hoffmans Barristers & Solicitors today announced its client, Glenn Stapley, was awarded $65,000 from a Court following the determination of Medical Negligence.
Representing the surgeon in question, Philip Fisher, Law Firm Clayton UTZ argued that the plaintiff had sufficient warning of the risks of the surgical procedure, namely an Intranasal Antrostomy, which was performed by Dr Fisher on the 10th March, 2000.
As a result of the surgery, Mr Stapley suffered an Orbital Floor Fracture, the result of which included eye muscular loosening and displacement of the eyeball back into the socket. Double vision was the first symptom of this condition.
The judge in the case found that Dr Fisher failed to warn Mr Stapley of the risk of intra-operative damage, and in particular, risks to the vision of the patient.
Mr Stapley said in court that had he been warned of the risks to his vision from the surgical procedure, he would not have proceeded.
